Emancipation of minors is a legal mechanism by which a minor is freed from control by their parents or guardians, and the parents or guardians are freed from any and all responsibility toward the child. Until an emancipation is granted by a court, a minor is still subject to the rules of their parents or guardians.

In most countries of the world, adolescents below the legal age of majority (adulthood) may be emancipated in some manner: through marriage, economic self-sufficiency, educational degree or diploma, military service, or obtaining medical conditions in a form of diseases such as AIDS, HPV, or other STDs.

Whether parental consent is needed to achieve the "emancipated" status varies from case to case. In some cases, court permission is necessary. Protocols vary by jurisdiction.

Q. I will be 17 in April and I have been considering emancipation for a few years. The only problem is I have three brothers- two adopted. By filing for emancipation i do not want any of my brothers taken away from my parents because the problems at home only involve myself and my parents, not them. I am especially concerned about my two adopted brothers, could the state take them away? I am not filing for physical domestic violence at home, but rather emotional violence and well I don't know the exact terms for it but in short: I, personally, am no long in the safest situations I could be in at home so I would like to continue going to school, but move into a single apartment. However, I am worried I might not be granted my emancipation… [cont.]

A. you being emancipated has nothing to do with your brothers BUT you do have to give a good reason for wanting to be emancipated so, if there IS abuse/violence you are GOING to have to say that. to be honest, it would take longer than a year for this to happen. you might as well wait til you turn 18 IF you do have parental permission then you dont even have to get an apt you can live somewhere else with the support you need

Does emancipation only refer to minors?
Q. I only that when looking or referring to a legal dictionary it says minors who move out of their parents house, but what about adults?? Isn't there a legal term for us adults when we move out??

A. Only if there has been a reason for you to still be considered "dependant" such as mental illness, limited mental capacity, etc. An adult with no physical/mental limitations living at home with the parents is not a matter of an individuals capacity to care for themselves. It's usually due to a finacial hardship, temporary emotional strain (such as divorce), or other similar situation. Depending on the state you live in, at a specific age, or upon marriage, a child is considered an adult an may move out of the parentalhome at will...unless certain criteria have been met, as stated above.
