what is the law on the emancipation of minors in new york state?
Q. i cannot find article 686 chapter 6 of new york state law. which indicates the law on emancipation of minors in new york state. a close friend of mine is being abused by here parents and wants out as soon as possible.

A. In order to become emmancipated your friend will need to to file a petition in your counties Family Court. She can do this by visiting the Family Court and requesting the petition and then completeing it herself or taking it to a lawyer. In order to be emmanicipated she will have to be able to prove to a judge that she is fully capable of caring for herself financially and emotionally without the assistance of her family. This is not an easy task and not something to be taken lightly. If she is truly being abused, then her first step should be to contact the New York State Child Protective Services Registry:1-800-342-3720 They will investigate and if they believe she is being abused they will intervene and take her out of the home. … [cont.]

Do parents have to consent to emancipation of minors in virginia?
Q. Also I was wondering what were the terms of the emancipation if the minor has not obtained a driver's license/learner's permit and does not own a car...Thanks!
Asked by ainsleydaisy - Fri Aug 1 10:01:18 2008 - - 5 Answers - 0 Comments
A. Parents do not have to consent if it is court ordered, as it was in my case in the state of Oregon at the age of 16. I don't think that a license to drive is required for emancipation. I did not have one. However, the minor needs to have a guaranteed source of income. If not, emancipation would be the equivalent of a free pass to street-kidhood. Foster care is much more likely in the case of family problems. No court will emancipate a minor just because they want out of the house earlier. If the parents want the kid out of the house and the child wants the same, no emancipation order is needed.

Emancipation of minors?
Q. According to Wikipedia "In most countries of the world, adolescents below the legal age of majority may be emancipated somehow: through marriage, economic self-sufficiency, educational degree/diploma or pregnancy." So, if a minor can get emancipated through marriage, how do we reconcile this with the Statutory rape laws that forbid sex with a minor? Would somebody that had sex with a minor escape being convicted of Statutory rape by marrying the person he/she had sex with? It is a valid LEGAL question, on real issues. Not an issue about the morality (or lack thereof) of it all. Dude: Actually it is. This is what it says about the US. A Question about Emancipation of Minors and Name Change Laws (American Laws)?
Q. If a minor that is 16 years old, a US Citizen and born in the state of Florida, and a resident of Florida wants to legally change his name, but the law says that if he is a minor (under 18), he needs "parental consent", but the parent will not consent to the name change but will consent to emancipation, can the minor change his name if he is emancipated? Does the minor still need to be 18 to change his name after emancipation, or can he do it at 16?

Emancipation of minors in Florida?
Q. Ok, here is the thing I am 15 and I cant stand living with my mom. She kicked me out for a night and one day just a couple of days ago.' She is constantly verbally abusive towards me and I feel like I am going to hurt her (not planned just kinda snap) one day in the next 3 yrs. So how in the state of Florida could I get empancipated?

A. Do you have a job? Do you have a place to live? Can you provide for your food, personal needs, and medical care? How do you intend to complete your education? These are all questions you must answer before a judge would even consider allowing you to be emancipated. There also must be extenuating circumstances that warrant removing you from your home and allowing you to live on your own. It sounds as if you and your mother both could benefit from counseling. Many areas have Community Service Boards that provide services at a free, or reduced, rate. You and your mother both need to learn how do deal with stress without resorting to verbal or physical abuse.

A. This is a really good website that can explain most of what you will need to know. You will need to file a Petition for Emancipation and the judge has to rule in your favor. Honestly, unless your situation is an exception, I would just wait until you turn 18.

A. No way she will be emancipated. She would have to prove that she has a job that is going to pay for her entire support. She will have to show how she is going to pay rent, food, clothing, utilit ies, insurance. Without a job, that is impossible. Relying on someone else or the government for any part of her support will not get her emancipated. If she is here on a visa, she will be expected to leave the country when that visa expires. If she doesn't have a visa or a green card, she is here illegally. She has no chance at emancipation.

Question regarding the emancipation of minors?
Q. I'm not asking because I wish to be an emancipatedminor. However, I'm a writer and I'd love some information on it. First of all, what's the earliest a child could become an emancipated minor? Would sixteen be acceptable? If the child's only legal guardian or willing relative, her mother, was a heroin addict, and the 16-year-old wanted to become emancipated (and she had the means to support herself), could she petition for that? Final question: if this individual had a 10-year-old brother (who she'd always cared for anyway because of the mother's neglect) and the girl could prove that she was able to care for herself and the child, would it be possible that she could be granted custody of her brother (perhaps with a probational status-… [cont.]

emancipation? minor living alone?
Q. I will be 17 in April and I have been considering emancipation for a few years. The only problem is I have three brothers- two adopted. By filing for emancipation i do not want any of my brothers taken away from my parents because the problems at home only involve myself and my parents, not them. I am especially concerned about my two adopted brothers, could the state take them away? I am not filing for physical domestic violence at home, but rather emotional violence and well I don't know the exact terms for it but in short: I, personally, am no long in the safest situations I could be in at home so I would like to continue going to school, but move into a single apartment. However, I am worried I might not be granted my emancipation… [cont.]

A. you being emancipated has nothing to do with your brothers BUT you do have to give a good reason for wanting to be emancipated so, if there IS abuse/violence you are GOING to have to say that. to be honest, it would take longer than a year for this to happen. you might as well wait til you turn 18 IF you do have parental permission then you dont even have to get an apt you can live somewhere else with the support you need

Does emancipation only refer to minors?
Q. I only that when looking or referring to a legal dictionary it says minors who move out of their parents house, but what about adults?? Isn't there a legal term for us adults when we move out??
Asked by lostsoul - Sun Feb 12 12:30:12 2006 - - 1 Answers - 0 Comments
A. Only if there has been a reason for you to still be considered "dependant" such as mental illness, limited mental capacity, etc. An adult with no physical/mental limitations living at home with the parents is not a matter of an individuals capacity to care for themselves. It's usually due to a finacial hardship, temporary emotional strain (such as divorce), or other similar situation. Depending on the state you live in, at a specific age, or upon marriage, a child is considered an adult an may move out of the parentalhome at will...unless certain criteria have been met, as stated above.
