What are the exact and specific requirements for Emancipation of minors in Texas?
Q. I have a friend who is 16 and has currently ran away from home. She is going to get a job and pay her own way through life... The question is, how long do you have to be in Texas to get emancipated, and other requirements... A. Hire an attorney. Go to court. File for emancipation. Get the judge to sign an order. Actually, Texas does not have a law to give a minor emancipation . However, it does have a law called Removal of Disability of Minority , located in Chapter 31 of the Texas Family Code. A teenager (at least 16 years-old) can apply through a local court for certain types of legal restrictions to be removed so that a teen can act as an adult and make certain decisions on her own without parental involvement. However, for the purposes of providing this written information, we will call this process emancipation . A. Parents do not have to consent if it is court ordered, as it was in my case in the state of Oregon at the age of 16. I don't think that a license to drive is required for emancipation. I did not have one. However, the minor needs to have a guaranteed source of income. If not, emancipation would be the equivalent of a free pass to street-kidhood. Foster care is much more likely in the case of family problems. No court will emancipate a minor just because they want out of the house earlier. If the parents want the kid out of the house and the child wants the same, no emancipation order is needed.

A. You already answered your own question. The person in question would be emancipated, and thus a legal adult, able to do all the things adults are able to, in a legal sense. The parent has no authority over them once their child's been emancipated. So, no, the emancipated minor wouldn't be a run away.

Q. My parents and I don't get along at all. It's not just a few fights once in a while, it's everyday. At least 3 times a day. My mom and dad sometimes get violet. A. Even if you do successfully emancipate yourself, you'll have to live in a foster home since you are still a minor. You're too young to have a job that would pay enough to support yourself, not to mention that your age prohibits your from working long hours and even getting an apartment... Really think this through, I know you can't stand your parents, but living on your own is very hard. TRUST ME, I left my house when I was 18 and it has been a non stop struggle... Good luck.

A. This is a really good website that can explain most of what you will need to know. You will need to file a Petition for Emancipation and the judge has to rule in your favor. Honestly, unless your situation is an exception, I would just wait until you turn 18.

A. No way she will be emancipated. She would have to prove that she has a job that is going to pay for her entire support. She will have to show how she is going to pay rent,food,clothing,utilit ies,insurance. Without a job,that is impossible. Relying on someone else or the government for any part of her support will not get her emancipated. If she is here on a visa,she will be expected to leave the country when that visa expires. If she doesn't have a visa or a green card,she is here illegally. She has no chance at emancipation.

A. you being emancipated has nothing to do with your brothers BUT you do have to give a good reason for wanting to be emancipated so, if there IS abuse/violence you are GOING to have to say that. to be honest, it would take longer than a year for this to happen. you might as well wait til you turn 18 IF you do have parental permission then you dont even have to get an apt you can live somewhere else with the support you need

Only if there has been a reason for you to still be considered "dependant" such as mental illness, limited mental capacity, etc. An adult with no physical/mental limitations living at home with the parents is not a matter of an individuals capacity to care for themselves. It's usually due to a finacial hardship, temporary emotional strain (such as divorce), or other similar situation. Depending on the state you live in, at a specific age, or upon marriage, a child is considered an adult an may move out of the parentalhome at will...unless certain criteria have been met, as stated above.
